Emily Keepers History Final May 7, 2012 Final Paper The North and South differed greatly economically. The southern communities were still lagging behind, relying on slave labor to keep their plantations producing. They made their money through farming and plantation work. There were a few that held a majority of the money. These people were the elite plantation owners. Pierce Butler, for example, owned Butler Island and was one of the wealthiest plantation owners. The South also followed the Culture of Deference. They believed that God put them in their places on purpose and that they should follow as He had planned. They relied on the bible to justify slavery. The northern communities, on the other hand, wanted change. They were†¦show more content†¦The southern communities were left in shambles. Slavery was ended because of fear of revolt and the possibility they could team up with the Native Americans and go on a killing spree. The fourteenth amendment to the Constitution set this point in history. Sadly, reconstruction was a complete failure. The Freedman’s Bureau lasted for only seven years, and with the northerners â€Å"waving the bloody shirt,† the southerners just wanted them to get out of their territory. The reconstruction finally ended with the Compromise of 1877. With this compromise, a Republican became president, even though the Democratic candidate won, and the northerners left the southern lands. The plantations began to go under without the free labor, and the newly freed slaves were homeless with no money or place to live. With some begging, Andrew Jackson agreed to give the plantation owners their land back. The former slaves returned to their plantations and now tried sharecropping. Against their liking, the children had to continue working the fields. Things continue this way until the Civil Rights Movement many years later. The Native American participation in the Civil War was very unique. The treaty party, or the Pro-removal Indians, saw expansion as inevitable. The British enlightenment was commonly referred to, as empiricism in Britain since the main characteristics of enlightenment namely search for knowledge and defiance of tradition were not so visible due to their social conditions. Nonetheless the things mainly targeted for change were hereditary aristocracy and religion especially Catholicism. (Gregory C. 116) This period of enlightenment in Britain was characterized by rise in intellectual life, which brought improvement in Britain’s key sector of agriculture. The economy also advanced due to this and more people moved to urban areas in such of prosperity especially London which had close to a million people at the time. There was also a chance for common people to explore fanatism and passions, which were earlier, deprived by traditions and beliefs. Enlightenment had its benefits but had its fair share of downfalls. Due to increasing urban population, citizens drank and gambled causing a decay of morals and family values, streets were filled with prostitutes and people had lack of respect to values once strongly upheld. (Gregory C. 112) Thinkers like John Locke and David Hume led this revolution. They believed that humanity was deeply inclined to emotion than reason thus sparking a wave of people who believed less in magic or supernatural things but more on the power of human reasoning. Enlightenment though welcomed openly in Europe especially in England, Scotland and France had its enemies most prolific being Karl Marx the founder of maxim or better known as socialism. It also led to uprisings like the French Revolution but all these did not deter the British from being enlightened thus forming the basis of capitalism and a new era. (Gregory C. 113) Conclusion The enlightenment is mostly viewed as an anomaly in our history when people believed perfect societies would be built in a matter of reasoning, sense and tolerating each other. But these infatuations can never be realized since religion is a key mover in modern society and still has a strong following of disciples who believe in supernatural beings and customary beliefs. Superstition is still a major setback in the enlightening of people. Introduction to Criminal Justice Essay This definition of a crime comes from (Merriam-Webster On-line Dictionary) and reads; â€Å"Crime: an act or the commission of an act that is forbidden or the omission of a duty that is commanded by a public law and that makes the offender liable to punishment by that law; especially: a gross violation of the law†. There are several definitions of crime, but there all consistent for the most part. People who commit crimes are held to answer for the crimes they are accused of. For this, we must have a judicial system in place that is fair and balanced. Although the person accused of committing the crime is sometimes judged before he’s even gone to court, he must be allowed certain rights and due process. Those rights must not be violated prior to a trial. It’s this system that makes American what we are. Sometimes there are cases that make us feel that the person being tried should just be executed or sent to jail, because the media has basically tried and convicted the person prior to trial. This was evident in the â€Å"Casey Anthony† murder trial. Most Americans and the media had convicted her prior to trial. She was found not guilty earlier today by twelve jurors. Is the system fair? Who knows, but this is the reason, lots of people believe there should be professional jurors for high profile cases like this. On the other hand our judicial system has been around for a long time and delivers in most cases a fair system of government that protects the innocent, the victims and the accused. Of course all parties involved don’t feel this way based on where you’re at during the judicial process, but it’s a system that’s fair to all parties. The system is overseen by federal systems that try to keep order and balance throughout the country. Without any of this we would be a country with no law and order. Vigilantes’ would run the streets creating their own laws and chaos would prevail. The three components of the criminal justice system are The Police, The Criminal Courts and The Correctional Institutions. Each one of these components has a very specific function and go hand in hand with one another. For example; if a person is arrested by a police officer for a residential burglary, there is a series of events that happen on the law enforcement side, before the suspect goes to court and before he becomes a part of the correctional institutions. . Once an officer confirms a crime has been committed, he must place the person under arrest and show there was probable cause to arrest the person. This information goes into a â€Å"Probable Cause statement that’s submitted during the booking process. If the suspect is questioned he must be advised of his Miranda rights by the law enforcement officer. Evidence must be collected to prove the crime was committed and the person being charged committed the crime. The suspect is then transported to the county jail for booking. The officer must then document the incident in a police report and be able to articulate the elements of the crime have been fulfilled. The evidence must be booked and the police report must then be submitted to the District Attorney’s office within a 48 hour time frame before the suspect is arraigned in court. If any of this fails’ to happen the courts could release the suspect under Penal Code 825. The case can still be submitted to the District Attorney’s office, but it will be filled out of custody. If this process has been completed correctly the criminal courts takes over their function. Once the suspect goes to court for his first appearance he is advised of his charges and the probable cause is confirmed by the courts. During this phase the report and evidence collected are examined by the defense counsel to see if the suspect has a chance of winning the case. If the defense attorney feels that his client may lose the case based off of the evidence presented he may be allowed to plea bargain in which the suspect could plead to a lesser crime or admit guilt to the crime he is accused of. There are several things that determine if this allowed to happen, to include the suspects past criminal history and the seriousness of the crime. If the courts feel there is enough probable cause and the suspect’s rights have not been violated, the suspect will be held to answer to the charges brought against him. Otherwise the suspect could be let free based on the lack of probable cause, lack of physical evidence or the suspect’s rights being violated during the arrest or questioning process. If the suspect is held to answer he will then go to an arraignment. Once there he will plead either not guilty, guilty, or no contest. If a person pleads â€Å"not guilty† he is set for pre-trial at which time his case is handled by the person’s lawyer. If need be the case goes to trial where he is judged by twelve of his peers or the person pleads to a lesser charge and the case is closed prior to the trial. If a trial takes place and the person is found guilty he will be sentenced by the judge based on the crimes committed. This can be immediately or shortly after the trial. If the suspect is sentenced to prison he then becomes a part of the correctional institution. After sentencing he is usually turned over immediately to the custody of the sheriff’s department while awaiting transportation to prison.

Cell phones have been around for centuries. On April 3, 1973 the first portable phone was introduced. Many Americans and people around the world use cell phones almost everyday. Cell phones do have pros, but they do have their cons too. Five pros on the cell phone are that they believe that cell phone use is not associated with the risk of developing a brain tumor. The second pro is that in 2000 the FDA and the International Association for the Wireless Telecommunications (CTIA) signed a research agreement for further investigation on the health effects of cell phones. After the investigation, they discovered that â€Å"no association was found between exposure to radiofrequency (RF) radiation from cell phones and adverse health effects. The third pro is that in May 2001 the GAO reports â€Å"Research and Regulatory Efforts on Mobile Phone Health Issues,† they did conclude that there had been no scientific evidence that can prove that cell phone radiation had any health effects, but that more research on the topic was indeed needed. The fourth pro is that Cell phones may be the world’s best invention to this day; â€Å"In 2008 the $148.1 billion wireless industry had over 270 million subscribers in the US (87% of the population) who used over 2.2 trillion minutes of call time.† The fifth pro is in December of 2012 the $185 billion wireless industry had gained 326,475,248 wireless subscriber connections in the US and 301,779 cell phone tower sites across the country. Gangs are a violent reality that people have to deal with in today†s cities. What has made these groups come about? Why do kids feel that being in a gang is both an acceptable and honorable way of life? The long-range answer to these questions can only be speculated, but in the short term the answer is easier to find. We must find ways and means to effectively implement the various strategies to end gang violence. I believe that three important institutions play a vital role in our struggle to fight gang violence. Some believe that gangs are caused by peer pressure. Many teens in gangs will pressure peers into becoming part of a gang by making it all sound glamorous. Other teens will use money as a crucial factor. A kid is shown that they could make a couple of hundred for small part time gang jobs. This includes selling drugs and robbing other people. In other areas like Bronx or the very worst case, Compton, children will be beaten and robbed if they do not join gangs. This is one reason why teens in these areas have to have friends in order for them to survive. Poor parenting also play†s a role why teens turns to gangs. Imagine in poor families with many children or middle-class families where parents are always working, the children will often feel deprived of love and attention. Parents often feel that putting food on the table is enough love. Children of these families may often go to the gang firstly out of boredom and to belong somewhere. Most parents do not have enough time to talk and listen to their kids. They do not spend any social activities with their children. Even teaching their kids the right values is jeopardizes. Most of the time, parents do not know what their children are doing for two reasons. In modern living-places, like cities or suburbs, where such a network is abused, he no longer has such sentries. Last but not least is the poor educational system. A lot of students are deprived of basic educations, which includes good skills in reading, writing, and arithmetic. If the educational system somehow ensure that each student actually does have access to equal opportunity for a quality education, then perhaps we will find these kids have a better future that holds something more than quitting school, hanging out in the â€Å"hood†, and making money at selling drugs. This is why gangs are more predominant in public school than private school. I am interested in this issue because I want to find out the best way I could prevent my kids from joining gangs. I do not have any experience growing up in this type of environment. I grew up in a place where gang affiliation is unheard of. This is why this is a major concern for me. These are the major factors why most of the teenagers turn to gangs. I believe that proper parenting plays the major role in preventing kids in joining gangs. Everything starts at home; from teaching your kids the right values and helping them develop self-esteem. Parents should teach their kids to value education because this is their key to better future. Parents should serve as a role model to their children. They should do everything possible to involve their children in supervised, positive group activities. Macbeth's Implacable Guilt    The Shakespearean tragedy Macbeth underscores the important and usually unforeseen effect of sin, that of guilt. The guilt is so deep that Lady Macbeth is pushed to suicide, and Macbeth fares only slightly better.    Blanche Coles states in Shakespeare's Four Giants that, regarding guilt in the play:    Briefly stated, and with elaborations to follow, Macbeth is the story of a kindly, upright man who was incited and goaded, by the woman he deeply loved, into committing a murder and then, because of his sensitive nature, was unable to bear the heavy burden of guilt that descended upon him as a result of that murder. (37)    In "Memoranda: Remarks on the Character of Lady Macbeth," Sarah Siddons mentions the guilt and ambition of Lady Macbeth and their effect:    [Re "I have given suck" (1.7.54ff.)] Even here, horrific as she is, she shews herself made by ambition, but not by nature, a perfectly savage creature. The very use of such a tender allusion in the midst of her dreadful language, persuades one unequivocally that she has really felt the maternal yearnings of a mother towards her babe, and that she considered this action the most enormous that ever required the strength of human nerves for its perpetration. Message I am thrilled to join Company X’s management team. My colleagues have been stellar in providing me support and helping me accilmate to the organizational culture, which is different from what I am accustomed to. I have encountered my first challenge, a challenge that is incumbent that I bring to your attention along with three detailed solutions, inclusive of attractive and detractive aspects of each. It is also important that I share with you the methodology I employed to arrive at these conclusions, since it is reasonable for you to have access to and test the methodology employed to engender these solutions. I will also recommend to you an appropriate course of action. Separately, I will present a report, which will report the findings of an analysis that I conducted on our company’s ethical decision-making process. This report will include strategies to mitigate against concerns I will have raised in the memorandum. I will also discuss the process of creating a code of ethics that will provide for employee growth through ethical decision making and continued company revenue growth. Production Concern Company X is the leader in the production of toy whistles for children the world over. Our principal production plant is located within the United States and, naturally, is under the purview of production guidelines set forth by the U.S. government. The quality-assurance department recently informed me of a production issue that has arisen. Toy whistles that have been manufactured and are on schedule for shipment undergo an arduous testing process to ensure that the  constitution of each toy meets federal regulations. Toy whistles that will be shipped to South American countries have, unfortunately, failed lead-level requirements; they are slightly higher in lead than what is legally tolerable. Our company has decisions to make about how we address this considerable concern. After analysis, collaboration with team members, and sufficient reflection, I have developed three solutions to address this concern. Each solution has attractive and detractive aspects, both of which I will discuss. Ethical, legal, and financial considerations must be made with all solutions. Solution 1: Cease shipment; Re-produce Toy Whistles At current lead levels, the toy whistle would not be shipped to customers. The entire production process would re-apply, which includes re-securing the raw materials necessary to make replacement whistles, re-producing those whistles through the production process, and commissioning the quality-assurance department to verify that the whistles meet all federal guidelines for selling and consumption. It will also be important that the quality-assurance department provide a quality verification of its own processes. Such a verification will be necessary, since antecedent quality processes failed to identify the higher-than-normal lead levels of our toy whistles. Solution 1: Explanation of Method Used to Select Solution A combination of brainstorming and SWOT analysis were employed to determine three solutions for our company’s quandary. The brainstorming process involved three team members who reviewed the situation and offered ideas—any ideas—as solutions. Each team member produced two ideas, totaling six possible solutions. Costly to hold up production. Opportunities: Favorable contract renegotiation if determined process failure with supplier. Possible acquisition of new customers if mitigative steps made known. Threats: Possible legal action from suppliers, employees, customers, and governments due to abrogation of contracts, inability to pay out on employee pensions, or willfully missed customer demand. Solution B is unquestionably not worthy of further consideration. Solution 1: Advantages and Disadvantages The important advantage this solution offers is that our toy whistles’ lead levels will not detrimentally influence the health of our customers. Our identification of this issue will allow our company to take mitigative actions before the whistles are in the hands of our consumers. Another advantage of this solution is that our customers will be unaware that there could have been an issue with the whistles. Our consumers’ ignorance allows our company to avoid a public-relations concern or public excoriation of our product and company brand. There are no government mandates that our company must disclose these sorts of issues if they are discovered before being delivered to our customers. An important disadvantage to this solution is that the investigative process and resultant process refinements will prove costly and timely. It is evident that a production and service failure has occurred, since our whistles’ lead levels currently contravene United States legislative mandates; however, we are not certain where in the supply chain this failure has occurred. Unnecessary people-power must be devoted to resolving this issue sufficiently to prevent issues in the similitude of this one. Another disadvantage to this solution is the effect it will have on employee morale. To be specific, the judgment of the managers of these processes is dubious and will have to be investigated. It is unquestionable that coaching and development, inclusive of corrective action, will have to be meted to all parties involved in this situation. And because of the cost of resolving this matter, some managers and their employees may have to have their employment terminated. No matter how delicately the corrective action will be handled, other employees will inevitable respond negatively. This situation may encourage discussions of unionization. It may engender unnecessary employee churn. Or for those who have their employment terminated as a result of our investigation, it may very well involve contending against ex-employee litigation for perceived wrongful termination, which will involve government agencies and their investigations. Solution 1: Ethical Considerations This solution is an ethically viable option. The reason is that the lead levels prescribed by the federal government are ostensibly predicated on customer saftey and, if more stringent, supersede lead-level requirements of the target country. Providing customers, especially young children, with high-lead toys is immediately unethical and demonstrates a disconnection from social responsibility. Solution 1: Financial Considerations This solution, however, is the most costly and will make profit from these sales impossible unless we increase the price of the toy whistles. The  following are cost considerations of this solution: 1. Vetting Raw-Material Supplier: It is possible that the raw materials that we obtain from our supplier do not possess the integrity that we expect, which would cause products to fail quality verfifcations. An audit would be required of the supplier. This audit would entail the following costs: a. On-site inspections: $10,000, inclusive of labor costs and travel expenditures b. Report of findings: $5,000, inclusive of labor costs of presenting the findings c. Negative findings: $10,000, inclusive of replacing and contracting with a different raw-materials supplier. d. Positive findings: $15,000, inclusive of sunk costs of on-site inspections and reporting of findings (since no issue would have been with the supplier) 2. Vetting Production Processes: There may be deficiencies in the production process that cause higher levels of lead to result in our products. Here are the costs associated with this vetting: e. Departmental inspections: $7,000, inclusive of labor costs f. Report of findings: $5,000, inclusive of labor costs of presenting the findings g. Negative findings: $50,000, inclusive of making process adjustments, training on new processes, and follow-up labor costs h. Positive findings: $12,000, inclusive of sunk costs of inspections and reporting of findings. As easily noted, the costs of making process changes are considerable. However, the costs of these changes should not, by themselves, be an impetus to continue to produce high-lead toy whistles.
